Couple win car finance victory

23/06/2008

A couple who risked losing their home in a car finance dispute have scored a landmark victory in the courts. Stuart and Lisa Griffiths-Peet, from Wigan, today warned others to read the small print on their car-finance agreements. Lawyers for the couple discovered that Yes Car Credit had provided a credit agreement with so many discrepancies that it was unenforceable. The couples £6,000 debt has now been written off. The car itself cost £4,000 when the couple took out their agreement with Yes Car Credit five years ago, but the additional £2,000 of car finance was for different types of insurance cover that the couple subsequently claimed they didnt really want. The Griffiths-Peets legal team said that the payment protection insurance should have been added to their invoice as a separate charge for credit. However, in the Yes Car Credit agreement, it was not. This, lawyers told the court, meant the credit was mis-stated and the agreement was "irredeemably unenforceable."
